Terms of Service

These terms cover the Fireside website and app (the "Service"). By creating an account you agree to them. If you do not agree, do not create an account.

1. Who can use it

You must be 18 or older and the parent or legal guardian of any child you add. By adding a child you confirm that.
Children use the Service only through a household you create and on a device you set up. They do not agree to these terms; you agree on their behalf.
During the pilot, the Service is offered for children aged 13 and older.

2. What the Service is, and is not

The Service is an AI assistant with a safety layer that you configure for your household. It is built so that certain protections cannot be turned off by anyone, including you, and so that above that floor your household's own values shape what it says.

It is not:

a substitute for you. It will hand hard questions back to you by design.
a medical, mental-health, legal or educational professional. If a child says something that suggests they may be in danger, it points them to the 988 Suicide & Crisis Lifeline and to you. It does not provide care.
perfect. It is built on a large language model. It can be wrong, and it can occasionally answer in a way you would not have chosen despite the safety layer. We test against that continually; we do not promise it never happens. Supervise your children's use as you see fit.

3. Your account and your household

Keep your password to yourself. You are responsible for what happens under your account, including on devices you set up for children.
Give us accurate information about your children's ages. The safety layer uses age to set limits.
One household per account.

4. Acceptable use

You agree not to:

try to disable, bypass or reverse-engineer the safety layer, or use the Service to generate content it is designed to refuse;
use the Service for anyone who is not a member of your household;
use it in a way that breaks the law or violates someone else's rights;
resell it, scrape it, or overload it.

We may suspend or close an account that does these things. A child's attempt to talk the assistant out of its rules is not a breach by you. It is recorded and you are told, and that is the end of it.

5. Your content

What you write (values, rules) and what your children write (messages, picture requests) is yours. You give us the right to store it and send it to our AI provider solely to run the Service for you, as described in the Privacy Policy. We do not use it to train AI models, and we do not use it for advertising.

The assistant's replies and generated pictures are yours to keep and use within your family. We make no claim on them, and we make no promise about their originality.

6. Price

The Service is free on the Free plan, which holds up to 5 children. Each child has a daily allowance, currently 100 messages and 5 pictures a day, within a daily amount of AI use for the household. When the day's allowance is used up, the child is told plainly and it comes back the next day. We may change the allowance; if we lower it we will tell you first.

Nothing is charged today. We will tell you in writing, at least 30 days in advance, before anything is charged, and you will be able to delete your account before then with nothing owed.

7. Ending things

You can delete your account at any time from the dashboard. Everything in the household is deleted immediately (see the Privacy Policy).
We can suspend or end an account for breach of section 4, or end the Service altogether with 30 days' notice, in which case we tell you first and delete your data as the Privacy Policy describes.

8. Changes to the Service or these terms

We will change the Service over time. If we change these terms in a way that matters, we will email the parent on the account before the change takes effect. Continuing to use the Service after that is agreement to the new terms.

9. Disclaimers and limits

The Service is provided as is. We do not promise that it is free of errors or that the safety layer catches everything. To the extent the law allows, our liability to you for anything arising from the Service is limited to what you have paid us in the twelve months before the claim, which during the free pilot is nothing. Nothing in these terms limits any liability that cannot be limited by law.

10. Disputes and governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute about them or the Service will be brought in the state or federal courts located in Utah, and you agree to their jurisdiction. Before bringing a claim, please write to us at the address below; most things can be sorted out by email.
